New Jersey’s adult-use law allows “cannabis consumption areas,” but only as an endorsement to existing licenses. The Cannabis Regulatory Commission (CRC) decided not to create a new license class; instead, licensed Class 5 retailers (or permitted medical dispensaries) can apply for a Consumption Area Endorsement to their facility. This means only approved dispensaries (currently still coming online in NJ) can add a 21+ onsite use room. Applications for consumption area endorsements opened in January 2025.

Licensing Process (Endorsement)

Hold or Apply for Class 5 Retail License

Only an adult-use retailer or medical dispensary (with a consumption area permission) can host a lounge. If you aren’t one already, consider partnering with a dispensary applicant or pursuing a license yourself.

Municipal Approval

New Jersey requires municipal endorsement (similar to a local permit) for every consumption area. Before applying, the dispensary must obtain local approval indicating zoning compliance and no local ban. Towns can limit numbers or outright prohibit consumption areas.

Complete CRC Application

As of Jan 2025, use the CRC online portal to apply for the consumption area endorsement. The application fee is $200 (non-refundable) and the endorsement fee is $800 for Class 5 retailers. Submit required documents: your approved Host Community Agreement, floor plan of the lounge area, SOPs for safe consumption (standard operating procedures including emergency plans), signage plan, and proof of local endorsement.

Inspections and Issuance

After review, the CRC will inspect the facility to confirm the consumption area meets regulations (age-gated, separate from sales area, no open exit to outside). If compliant, they issue the endorsement. The licensee then pays an annual fee ($5,000) for the consumption area addition and may open.

New Jersey’s rules require lounges to abide by strict controls.

  • No one under 21 may enter the consumption area. Security (cameras covering entrance and lounge) is mandatory.
  • Only cannabis from state-licensed sources may be consumed; licensees must have procedures to verify that customers bring in legally purchased product.
  • Serving staff must complete an OSHA-style intoxication training (similar to alcoholic beverage servers).
  • New Jersey forbids transferring cannabis across the boundary (no entry or exit with cannabis); thus, joint lockers or sealed containers are typically used.
  • The consumption space must be distinctly designated inside the dispensary – often a room separated by an internal door with controlled access.
  • Food is allowed (and infusing cafes are being considered), but New Jersey has not yet finalized rules on infused edibles on-site.
  • Smoking and vaping are both allowed indoors in NJ’s consumption areas, provided ventilation meets the state building code (follow your architect’s guidance on exhaust fans).

  • Municipalities have significant power: they can impose stricter rules or caps on consumption endorsements. For example, a town might allow only one consumption area per dispensary, or no more than two citywide.
  • The application platform indicates that local zoning requirements must all be satisfied or the application is automatically denied.
  • Be aware that Diversely-Owned or Social Equity retailers get priority scheduling to apply for endorsements to encourage fair access
  • Given the mandatory OSHA training, have your staff (including security) trained in the state’s required program before opening.

Who can operate a New Jersey consumption lounge?

Only a licensed Class 5 Recreational Retailer or a permitted medical dispensary. You can’t get a stand-alone consumption lounge permit if you aren’t already a retailer/dispensary.

How do I apply for a New Jersey cannabis lounge license?

If you qualify, submit a Consumption Area Endorsement application via the NJ Cannabis Business Portal. Applications opened Jan 2, 2025. Fill out the online form and upload required documentation (floor plan, SOPs, etc.).

Is there a deadline to apply?

No – applications are accepted on a rolling basis. However, priority is given to certain groups (e.g. Social Equity retailers). It’s wise to apply as soon as possible once local approval is secured.

Can the local town stop me from opening a New Jersey cannabis lounge?

Yes. The municipality must give an endorsement. If the town’s ordinances forbid consumption areas, they can simply deny the municipal endorsement and the state application won’t proceed. Many towns are still drafting such ordinances.

What are operating rules for lounges?

Patrons must be 21+. No one may carry cannabis out of the lounge. All product must be in sealed packaging (brought from home or bought at the dispensary’s retail counter). OSHA-style intoxication training for all staff is required.

Is alcohol allowed in New Jersey cannabis lounges?
