Nebraska’s Cannabis Licensing Framework

On November 5th, 2024, measures 437 and 438 were both approved by voters initially legalizing medical use, but the validity of both of these measures where challenged by opponents contesting the legitimacy of almost 49,000 signatures on the two petitions. The lawsuit was resolved on December 11, 2024, when Lancaster County District Court Judge Susan Strong ruled she would not issue an injunction, allowing the law to go into effect on December 12, 2024.

The ballot measures legalized the sale and possession of up to 5 ounces of cannabis for medical use, and established a Nebraska Medical Cannabis Commission as the state regulatory agency. These measures would not legalize the cultivation of cannabis.

As Nebraska moves closer to legalizing cannabis for medical use, regulatory details are likely to focus on public safety, community impact, and economic development. State regulators will prioritize applicants who demonstrate compliance, operational readiness, and alignment with Nebraska’s goals. As you prepare your application, partnering with our knowledgeable Nebraska Cannabis Consultants can help you navigate these emerging requirements.

While specific licensing frameworks are still under development, applicants can expect:

  • Merit-Based Licensing: Preference for applicants with robust business plans, community impact strategies, and financial stability.
  • Strict Compliance Requirements: Adherence to local and state laws, including zoning, security, and operational protocols.
  • Equity and Sustainability Initiatives: Favorable consideration for businesses that promote diversity and implement environmentally friendly practices.

Starting early and working with our Nebraska Cannabis Consulting team is key to successfully navigating the licensing process.

Key Licensing Challenges

The road to obtaining a medical cannabis license in Nebraska is evolving but will prove challenging.  Applicants must balance regulatory compliance, financial planning, and operational readiness while meeting strict deadlines. Below are the most common hurdles businesses should consider now if pursuing a license in Nebraska:

Pre-Planning Steps: Setting the Stage for Success

Pre-planning is the foundation of a successful application. We recommend starting the process at least 90 days in advance to allow time for research, preparation, and strategy development.

Key pre-planning considerations include:

  • Municipal Approvals: Many Nebraska municipalities may impose additional zoning or permitting requirements. Securing local support early is essential.
  • Due Diligence: Collecting necessary documentation, such as funding proof, facility agreements, and compliance plans, takes time and attention to detail.
  • Understanding the Laws: Nebraska’s regulations will likely be stringent, requiring careful interpretation to avoid errors.

Our Nebraska Cannabis Consulting team works closely with clients to ensure all pre-planning elements are addressed, helping you lay a strong foundation for success.

Building a Strong Application

A strong application is more than a technical document—it’s a narrative that demonstrates why your business is the right fit for Nebraska’s cannabis market.

Applications typically require:

  • Detailed business plans outlining your vision and operational strategy.
  • Security protocols to ensure safe and compliant operations.
  • Financial documentation to prove funding and sustainability.
  • Evidence of community engagement and economic impact.

Our team excels at crafting comprehensive and compelling applications that highlight your strengths and align with state priorities.

Financial Readiness: Meeting Capital-Intensive Requirements

Cannabis licensing is capital-intensive, and Nebraska’s process is expected to follow this trend. To be approved for a Nebraska medical cannabis license, applicants must demonstrate financial readiness to cover licensing fees, facility costs, and operational expenses.

Key financial considerations include:

  • Startup Costs: Licensing fees, facility build-outs, and equipment purchases can be significant.
  • Operational Capital: Businesses need enough funding to sustain operations until profitability is achieved.
  • Proof of Funding: Applicants must provide detailed documentation of funding sources, whether through investors, loans, or personal capital.

Steps include:

  • Identifying properties in compliant zones.
  • Conducting security assessments and environmental evaluations.
  • Developing facility designs that adhere to Nebraska’s regulations.

The lawsuit was resolved on December 11, 2024, when Lancaster County District Court Judge Susan Strong ruled she would not issue an injunction, allowing the law to go into effect on December 12, 2024.

Cannabis Application and Licensing Agency in Nebraska (Nebraska Medical Cannabis Commission)

The Nebraska Medical Cannabis Commission has been established as the regulatory body that will oversee the Nebraska Medical Cannabis program.

The first three members of the Nebraska Medical Cannabis Commission will be the three members of the Nebraska Liquor Control Commission. The governor can appoint two more members, which would need confirmation from the legislature. The commission will also have staff.

Nebraska Cannabis License Application Pre-Planning

Prepare now by researching and writing the operational plans for your business—you’ll need these plans later when you submit your application to the Nebraska Medical Cannabis Commission. All plans must be compliant with medical-use regulations.

Some plans include, but are not limited to: a business plan, a diversity plan, a security plan, a plan for positive impact, and a plan to remain compliant with local codes and ordinances. Each plan should be tailored to your application and include items required in the regulations.

Documentation is the cornerstone and will determine your success in winning a Nebraska cannabis license. Our Nebraska cannabis consulting team will lead and coach you through the gathering and production of required documentation. Book your free Nebraska cannabis consultation now to get started.

Cannabis License Types in Nebraska

It’s expected there will be five unique license types available for Nebraska cannabis business owners:

• Nebraska Cannabis Cultivation
• Nebraska Cannabis Dispensary
• Nebraska Cannabis Infused Product Manufacturing
• Nebraska Cannabis Labratory Testing
• Nebraska Cannabis Tranportation

Each of these license types will have unique application requirements (TBD). It’s expected Nebraska will follow a similar framework to other legalized states requiring a business plan, a diversity plan, a security plan, a plan for positive impact, and a plan to remain compliant with local codes and ordinances. Our Nebraska Cannabis Consultants can help you determine which license type best fits your business.

Nebraska Cannabis Application and Licensing Fees

Three legislative bills have been introduced to help implement the voter-enacted legalization and regulation of medical cannabis in Nebraska by mid-late 2025.

The legislation, introduced by State Sens. Danielle Conrad of Lincoln, Ben Hansen of Blair and Terrell McKinney of Omaha, would create registry programs and further stipulate the licensing and regulatory duties of the new Nebraska Medical Cannabis Commission.

All three would allow Nebraskans, after receiving a written recommendation from a health care practitioner for medical cannabis, to apply for a registry card, identifying them as a qualified patient. The registry would similarly apply to registered caregivers, such as for minors.

All three bills would establish more specific licensing requirements, similar to alcohol establishments now, with set fees, license types or business tiers.

The bills, which are all structurally similar with some key differences, are: Legislative Bill 651 (Conrad), LB 677 (Hansen) and LB 705 (McKinney).
