Who regulates medical cannabis in Nebraska?
The Nebraska Medical Cannabis Commission, created by Initiative 438 in November 2024, is the body responsible for regulating medical cannabis in Nebraska, including rulemaking and the licensing of establishments. Because it is a new regulator, its rules, forms and timelines are the single most important thing for a prospective Nebraska operator to track, and they should be read at source.
What did Initiatives 437 and 438 actually do?
Initiative 437 protects qualifying patients who possess medical cannabis with a written recommendation from a licensed healthcare practitioner. Initiative 438 establishes the regulatory framework and creates the Nebraska Medical Cannabis Commission to license and oversee establishments. Together they authorise a medical program only. Neither measure created an adult-use market, and neither by itself put a single license on the street.
When will Nebraska issue medical cannabis licenses?
We will not give you a date, because the honest answer is that the timetable in the ballot measure has already slipped and the program has faced litigation and legislative dispute. The Nebraska Medical Cannabis Commission publishes the live position. Plan your capital so that a delay of another year does not damage you, and hold options rather than leases.
What should a Nebraska operator be doing right now?
Four things. Track and comment on Commission rulemaking, because rules written without operator input cost you for a decade. Structure your entity and ownership now. Option a site with confirmed zoning and utility capacity instead of leasing one. Draft the operating, security and cultivation plans that any framework will require. Is hemp or CBD legal in Nebraska?
Nebraska authorised hemp production under state law following the federal 2018 Farm Bill, and hemp-derived products are sold in the state, but the treatment of intoxicating hemp-derived cannabinoids has been contested and enforcement has been active. That is a different legal question from medical cannabis licensing, and it should be taken to Nebraska counsel rather than assumed from another state’s position.
Should I sign a lease for a Nebraska cannabis site now?
We would advise against a lease with a hard rent commencement date. Nebraska has no licensing program open, so a lease can burn capital for years against an asset you cannot use. Negotiate an option or a contingent lease that starts on license issuance, confirm municipal zoning first, and verify utility service capacity before you pay anything.
