Rhode Island Cannabis Application Guide

As a cannabis license applicant, you should read the laws and regulations that govern Rhode Island’s cannabis industry. The Rhode Island Cannabis Act is the most important document for you to read.

Under the Rhode Island Cannabis Act, five types of adult-use cannabis business licenses have been made available in the state:

  • Hybrid retailer (medical and adult-use cannabis)
  • Retailer
  • Testing laboratory

To apply for a cannabis business license in Rhode Island, you must meet the following basic eligibility requirements:

  • You (and all owners) must be over the age of 21
  • You (and all owners) must be free of disqualifying convictions

The following individuals are required to apply for and receive a Registry Identification Card before commencing work in Rhode Island’s cannabis, hemp, and CBD industries:

• Shareholders (excluding those owning less than 5% of the outstanding shares of publicly traded companies)

• Managers
• Employees (excluding those employed by a Licensed CBD Retailer)
• Agents
• Volunteers

Additionally, all the above individuals, with the exception of Employees and Volunteers, are required to complete a National Criminal Background Check at their local law enforcement office with the results forward to the Rhode Island Office of the Attorney General.

Requirements for, and distribution of, Registry Identification Cards by OCR are pursuant to the Edward O. Hawkins and Thomas C. Slater Medical Marijuana Act, R.I. Gen. Laws Chapter 21-28.6-12(c)(6) and 21-28.6-16(b), and the Rules and Regulations Related to the Medical Marijuana Program Administered by the OCR at the Department of Business Regulation, 230-RICR-80-05-1.4, as well as the Hemp Growth Act, R.I. Gen. Laws Chapter 2-26-5 and 2-26-6, and the Rules and Regulations Related to the Rhode Island Industrial Hemp Program Administered by the OCR at the Department of Business Regulation, 230-RICR-80-10-1.10.

  • Zone 2: Johnston, Lincoln, North Providence, Central Falls, and Providence.
  • Zone 3: Coventry, Foster, Scituate, West Greenwich, and West Warwick.
  • Zone 4: East Greenwich, North Kingstown, Cranston, and Warwick.
  • Zone 5: Charlestown, Exeter, Hopkinton, Narragansett, Richmond, South Kingstown and Westerly.
  • Zone 6: Barrington, Bristol, Jamestown, Little Compton, Middletown, New Shoreham, Portsmouth, Tiverton, Warren, East Providence, Newport, and Pawtucket.

You will need to apply for a business license to operate in the corresponding geographical zone where your business is to be located.

However, when you apply, you are expected to demonstrate that you have the significant financial resources required to operate a business for the first two or three years — with proof of a certain level of liquidity, cash on hand, and/or CPA and/or bank letters.

  • Operational Timeline: Rhode Island recreational cannabis license holders must become operational within 12 months, with extensions available.

To qualify, applicants must meet one of the following:

  1. Residency in a Disproportionally Impacted Area: Lived in such an area of Rhode Island for five of the last ten years and have an income below 400% of the median income.
  2. Cannabis-Related Arrest or Family Impact: Either personally arrested for cannabis-related offenses or have a close family member (parent, child, or spouse) who has been arrested.
