Who regulates cannabis in Missouri?
The Division of Cannabis Regulation, part of the Missouri Department of Health and Senior Services, regulates both adult-use and medical cannabis. It issues comprehensive and microbusiness licenses, runs the microbusiness lotteries, conducts inspections and enforces inventory tracking. Its authority comes from Article XIV of the Missouri Constitution, created by Amendment 2 in 2018 and expanded by Amendment 3 in November 2022.
What is a Missouri cannabis microbusiness license?
A microbusiness license is the entry route Amendment 3 created for applicants who could not compete for capped comprehensive licenses. It comes in wholesale and dispensary forms, carries smaller operating limits, and is reserved for applicants meeting eligibility criteria based on income and net worth, residence in a high poverty or high arrest area, a non violent marijuana offence, disability, or service disabled veteran status.
How does the Missouri microbusiness lottery work?
DHSS opens an application round, verifies each applicant against the eligibility criteria, then draws winners at random. Licenses are distributed evenly across Missouri’s eight congressional districts, with wholesale and dispensary categories allocated separately in each. Because selection is random rather than scored, no part of your application earns points and eligibility documentation is where the entire outcome is decided.
Why has Missouri revoked microbusiness licenses?
The Division of Cannabis Regulation has revoked awarded microbusiness licenses where post award review found that the eligible individual named on the application did not actually own and control the business, or that stated eligibility could not be substantiated. Structuring the entity honestly and documenting it properly before the draw is the only protection against losing a license you have already won.
Is Missouri issuing new comprehensive cannabis licenses?
Comprehensive cultivation, manufacturing and dispensary licenses are capped per congressional district under Article XIV and were largely converted from the medical program, so new comprehensive licenses are not routinely issued. Realistic entry is through a microbusiness lottery round or through acquiring an existing licensed entity. We run diligence on acquisition targets as often as we write applications here.
Do I have to be a Missouri resident to hold a cannabis license?
For microbusiness licenses, majority ownership by qualifying Missouri residents is part of the eligibility structure, and residence duration is verified. The requirement is one of the items the Division checks most closely after award. Confirm your specific position with counsel, because an ownership structure that fails verification can cost you the license after you have won it.
What does Missouri DHSS inspect after you are licensed?
Inventory tracking reconciliation against physical counts, video surveillance coverage and retention, limited access area controls, waste destruction documentation, employee agent identification cards, transport manifests and product testing records.
