Yes. Adults 21 and over have been able to possess and home cultivate cannabis in Minnesota since August 1, 2023 under HF 100, and medical cannabis has been legal for longer. Commercial cultivation, manufacturing and retail sales require a license from the Office of Cannabis Management, so possession legality and the licensed market opened on different timelines.

The Office of Cannabis Management, or OCM, regulates cannabis in Minnesota. It issues every commercial license type, runs the license lotteries and social equity verification, enforces inventory tracking, packaging and testing rules, and has absorbed the medical cannabis program and the lower potency hemp edible framework. HF 100, enacted in 2023, created the agency and the licensing structure it administers.

For capped license types, the OCM reviews applications against threshold requirements and then draws winners randomly from the qualified pool, with social equity verified applicants given priority access. There is no merit score, so no part of the application earns bonus points. The entire objective is clearing verification and every threshold item without a defect that removes you from the draw.

Minnesota’s social equity criteria include having a qualifying cannabis conviction or a close family member with one, residence for a defined period in an area disproportionately affected by cannabis enforcement or with high poverty, and military veteran status including those who lost honorable status due to a cannabis offense. Verification is applied for separately and before the license application.

Cultivator, manufacturer, retailer, wholesaler, transporter, testing facility, delivery service, event organizer and medical combination business, plus microbusiness and mezzobusiness tiers that combine several functions in one vertically integrated license. Microbusiness is the usual entry point for a Minnesota operator without institutional capital, and mezzobusiness sits above it with a larger permitted canopy and higher fees.
