Who regulates cannabis in Oklahoma?
The Oklahoma Medical Marijuana Authority, or OMMA, regulates medical cannabis in Oklahoma. It licenses growers, processors, dispensaries, transporters, testing laboratories and waste disposal facilities, registers patients and caregivers, and conducts inspections and enforcement. OMMA was created after voters approved State Question 788 in June 2018 and later became a standalone agency rather than a division of the health department.
Is recreational cannabis legal in Oklahoma?
No. Oklahoma remains a medical only market under State Question 788, approved by voters in June 2018. A separate adult-use ballot measure was put to Oklahoma voters and did not pass, so any business plan for this state has to be built on registered patient demand rather than on an assumption that adult-use is imminent.
Does Oklahoma cap the number of cannabis licenses?
State Question 788 set no statewide numerical cap and no competitive scoring, which is why Oklahoma issued more commercial licenses per capita than any other state. The legislature has since imposed moratorium periods pausing new commercial license issuance while the backlog and enforcement caught up. Confirm the current OMMA issuance status before you plan around a new license.
Do I need to be an Oklahoma resident to own a cannabis business?
Yes, in substance. Oklahoma requires that a commercial medical cannabis license be at least 75% owned by individuals who are Oklahoma residents meeting the state’s continuous residency test. This is a threshold eligibility question rather than a detail, and ghost ownership arrangements that fail it have been a specific focus of OMMA enforcement action.
Why did Oklahoma cannabis prices collapse?
Because open issuance created far more licensed cultivation than the registered patient base could absorb. With no cap and no competitive round, supply outran demand, wholesale prices fell to among the lowest in the country, and the market moved into consolidation and enforcement driven attrition. Survival in Oklahoma now depends on fully loaded cost per pound rather than on holding a license.
What does OMMA look at during an inspection?
Seed to sale inventory reconciliation against physical counts, mandatory laboratory testing results, transport manifests, video surveillance coverage and retention, secure storage, waste destruction records, employee credentials, bonding and ownership and residency documentation.
