On November 5th, 2024, measures 437 and 438 were both approved by voters initially legalizing medical use, but the validity of both of these measures where challenged by opponents contesting the legitimacy of almost 49,000 signatures on the two petitions. The lawsuit was resolved on December 11, 2024, when Lancaster County District Court Judge Susan Strong ruled she would not issue an injunction, allowing the law to go into effect on December 12, 2024.
The ballot measures legalized the sale and possession of up to 5 ounces of cannabis for medical use, and established a Nebraska Medical Cannabis Commission as the state regulatory agency. These measures would not legalize the cultivation of cannabis.

Cannabis Application and Licensing Agency in Nebraska (Nebraska Medical Cannabis Commission)
The Nebraska Medical Cannabis Commission has been established as the regulatory body that will oversee the Nebraska Medical Cannabis program.
The first three members of the Nebraska Medical Cannabis Commission will be the three members of the Nebraska Liquor Control Commission. The governor can appoint two more members, which would need confirmation from the legislature. The commission will also have staff.

It’s expected there will be five unique license types available for Nebraska cannabis business owners:

Nebraska Cannabis Application and Licensing Fees
Three legislative bills have been introduced to help implement the voter-enacted legalization and regulation of medical cannabis in Nebraska by mid-late 2025.
The legislation, introduced by State Sens. Danielle Conrad of Lincoln, Ben Hansen of Blair and Terrell McKinney of Omaha, would create registry programs and further stipulate the licensing and regulatory duties of the new Nebraska Medical Cannabis Commission.
All three would allow Nebraskans, after receiving a written recommendation from a health care practitioner for medical cannabis, to apply for a registry card, identifying them as a qualified patient. The registry would similarly apply to registered caregivers, such as for minors.
All three bills would establish more specific licensing requirements, similar to alcohol establishments now, with set fees, license types or business tiers.
The bills, which are all structurally similar with some key differences, are: Legislative Bill 651 (Conrad), LB 677 (Hansen) and LB 705 (McKinney).
