The Georgia Access to Medical Cannabis Commission licenses and regulates in-state production, manufacturing and dispensing of low THC oil. Patient certification and the Low THC Oil Registry sit with the Department of Public Health, and industrial hemp is licensed separately by the Department of Agriculture. Three different agencies, three different applications, and operators regularly confuse them.

Georgia issues Class 1 production licenses at the larger indoor cultivation footprint, Class 2 production licenses at a smaller footprint, and dispensing licenses. Independent pharmacies have also been brought into dispensing low THC oil to registered patients. Georgia does not issue adult-use retail, delivery or consumption lounge licenses, because no adult-use market exists in the state.

Georgia issues production licences in defined, capped rounds rather than continuously, and past rounds were competitively scored and heavily litigated. Because the number available is small, preparation has to be complete before a round opens rather than started when it does. Georgia low THC oil is capped at 5% THC by weight, with a possession limit set in fluid ounces for registered patients. That ceiling is a manufacturing specification, and hitting it consistently requires cultivar selection, environmental control and batch testing discipline rather than blending after the fact. Products outside the specification are not saleable in Georgia.

No. Industrial and consumable hemp are licensed by the Georgia Department of Agriculture under the state hemp programme and are legally distinct from the low THC oil regime the Commission administers. Operators sometimes assume a hemp processor licence permits low THC oil production for registered patients. It does not, and the compliance obligations differ substantially.
