Ohio Cannabis Consulting

Yes. Ohio voters approved Issue 2 in November 2023, legalizing adult-use cannabis for adults 21 and over, and licensed adult-use retail sales began in August 2024. Medical cannabis has been legal separately since House Bill 523 in 2016. Any page or adviser still telling you Ohio is medical only is describing a market that ended two years ago.

The Division of Cannabis Control, or DCC, within the Ohio Department of Commerce. It licenses adult-use cultivators, processors, dispensaries and testing laboratories, administers the medical program created by House Bill 523, issues Certificates of Operation, conducts inspections and enforces seed to sale inventory tracking. The DCC became the single regulator when the Issue 2 adult-use framework was implemented.

Ohio licenses in defined rounds and conversion pathways announced by the Division of Cannabis Control rather than continuously, so whether anything is open depends on the date you are reading this. Much of the adult-use market was populated by dual use conversion of existing medical licensees. Catalyst BC tracks DCC announcements and will tell you the current status and what to assemble now.

A dual use certificate lets an existing Ohio medical cannabis licensee also serve adult-use customers from the same licensed premises rather than obtaining a separate adult-use license. It was the mechanism that allowed retail sales to begin quickly in August 2024. Conversion carries its own DCC documentation, inspection and operational requirements, and getting those wrong delays your adult-use revenue.

Ohio bands cultivation by permitted canopy. A Level I cultivator license carries the larger canopy allowance and the higher fee, and a Level II license carries a materially smaller allowance and lower fee, which makes Level II the realistic entry tier for operators without institutional capital. Your level determines your fee, your production ceiling and your entire cost per gram position.

Ohio municipalities have meaningful authority over whether and where cannabis businesses operate locally, alongside zoning, buffer distances and local approvals, and some jurisdictions have restricted or declined to permit them. Confirming your specific municipality’s current position before you sign a lease or an option is the cheapest step in the whole project and the most expensive one to skip.
